Caldeira analyzes a series of Gallup polls, taken during the months following his proposal, that measured public support for FDR’s plan to dilute the Court.

His procedure entailed analyzing the phenomenon that was theorized to be influencing the process under examination. Here, that phenomenon would be the president’s litigation status. He further explained that we can use information obtained from this analysis to determine whether a selection process is present in the primary process that we are examining through regression analysis. Here, of course, the primary process being examined is the likelihood that the justices will vote in favor of the president.

Thus, presidents (regardless of their partisan affiliation) might think twice before taking their case before a liberal Court.
